after, there shall be an election on the same rules -and regu-
lations as are prescribed in the third, fourth and fifth sec-
tions of this act, held for two persons to fill the vacancies
which occur under the last preceding section of this act,
and on the fust Wednesday of October in the year eighteen
hundred and forty-six, and on the same day in every second
year thereafter, there shall beheld under the name rules and
regulations an election for three persons to fill the vacan-
cies which shall then occur in the said board under the fur-
ther provisions of the last preceding section of this act.

CHAP. 179.

SEC. 10. Be it further enacted, That in the event of
a vacancy occurring by the death, resignation or removal from
the county or removal in the manner hereinafter provided, or
refusal to act if any member or members of the said board
upon the official information of the fact by the clerk of the
court of Carroll county, it shall be the duty of the Sheriff to
appoint a day for holding a new election for a commissioner
or commissioners to fill such vacancy upon at least ten day's
notice inclusive of the day of holding such election, which
said election under the provisions of this section shall be held
in the same manner and subject to the same regulations as
are prescribed in the sixth section of this act, and the per-
son having the highest number of votes in said county, and
who shall reside in the commissioner's district in which
such vacancy may exist, shall be declared to be duly elected.
SEC. 11 Be it, further enacted. That if any person to
he elected under this act shall be found guilty of mal-prac-
lice or corruption in office, upon indictment and conviction
in the county court of Carroll county, such person shall
from the time of such conviction be disqualified from hold-
ing the office of commissioner of tax of Carroll county for
the space of five years.

SEC. 12. Be it enacted, That election district number
two, of Carroll county, shall be the first commissioner's
district; election districts numbers one, and three, shall be
commissioner's district; election districts number six and
eight shall be the third commissioner's district; election
districts number four and seven, shall be the fourth com-
missioner's district; election districts five and nine shall
be the fifth commissioner's district.

SEC. 13. Be it further enacted, That the board of com-
missioners of tax of Carroll county, constituted and elected
under the provisions of this act, shall have all the authority
and powers now vested by law in, and be subject to all
such restrictions as are now imposed by law upon the ex-
isting board of commissioners of tax of Carroll county.
