approval.

with the provisions of this act, be and the same are hereby
repealed.
SEC. 15. And be it enacted, That it shall be the duty of
the voters of Carroll county, at the next annual election for
delegates to the general assembly, to signify their approval
of this act, by endorsing on their ballots either in writing
or printing, the words for electing commissioners, or against
electing commissioners, as the case may be, and it shall be
the duty of the judges of election in the aforesaid county in
counting said ballots to keep a list of the ballots so cast,
either for or against electing said commissioners, and it
shall be the duty of the return judges to transmit to the
Governor of this State a separate return of the ballots so
cast for and against electing said commissioners, and if it
shall appear from the said return of the ballots so cast, that
a majority of the whole number of voters of Carroll coun-
ty, who shall vote for delegates to the general assembly at
said election are in favor of electing said commissioners by
the people, it shall be the duty of the Governor to issue his
proclamation declaring the fact from and after which this
act shall be valid and effectual, but if from said return it
shall appear that there is not a majority of the voters of said
county in favor of electing said commissioners by the peo-
ple, then this act and every part thereof shall be utterly
null and void, and no election of commissioners shall be
held by virtue of the same.

An act to incorporate a company to make a Turnpike road
from some point on the National Road, al or west of the
Town of Cumberland, thence by the nearest and most prac-
tical route through any part of Allegany county, so as to
intersect the north western Turnpike Road of Virginia.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That James Swan, Meshack Browning, Moses
Rawlings, Michael Wilson, John Bernard, Louis F. Clep-
stein, Henry Miller, Jonathan Rhineheart, Henry Bruce,
Thomas Moore, John M'Henry, Benjamin S. Pigman, Ja-
cob Spangler, John Mosser, Jonathan Frantz, John Slicer,
Richard Fairall, Truman West, John Frantz, of Joseph,
John Hoye, Charles Oliver Frederick, Frederick A. Schley,
Thomas Perry, George M'Culloh, and Ralph Thayer, be,
and they are hereby appointed commissioners, who shall
