viso being to secure to each of the commissioner's district,
one member in the board of commissioners of tax consti-
tuted by this act.

In case of a
tie Sheriff to
give ten days
notice.

SEC. G. Be it further enacted, That in case of a
tie between two, in the same commissioner's district, in the
said first election, or any subsequent election as hereinafter
provided, it shall be the duty of the Sheriff upon receiving
official information of this fact from the clerk of said coun-
ty, to appoint a day for holding, a new election for commis-
sioner or commissioners upon at least ten clay's notice, ex-
clusive of the day of holding such election, and in the case
of such new election, the choice shall be made by the voters
of the county of a person residing in the commissioner's
district, in which the candidates tied shall reside.

SEC. 7. Be it further enacted, That every commissioner
elected as aforesaid, or to be elected as hereinafter provided,
shall before he enters upon the duties of this office, take and
subscribe the same oath or affirmation, and in the same
manner as is now prescribed by law.

SEC. 8. Be it further enacted, That at the first meeting
of the said hoard of commissioners of tax of Carroll coun-
ty, they shall determine by lot in the following manner their
terms of office, they shall elect by bollot or otherwise agree
upon three persons being qualified voters under the consti-
tution and laws of this State, who shall conduct the pro-
ceedings to determine their said terms as follows: the three
persons so selected shall prepare five scraps of paper of
equal size and appearance, upon two of which they shall
write one year, and upon three of which they shall write
two years, they shall then put those scraps of paper in a
hat or box to be drawn out, one by each of the five per-
sons elected as aforesaid, they shall then declare and certify
to the clerk of Carroll county that those who have drawn
the scraps of paper having one year written upon them, are
elected for the term of one year; and that those who have
drawn the scraps of paper having two years written upon
them, are elected for two years, which said certificates shall
be recorded along with the certificates of the return judges
herein provided for, and it is hereby provided that in case
the board should not be full, because of a tie, or for any
other cause, they shall nevertheless proceed to determine
their term as aforesaid, and such paper or papers as may re-
main in the hat or box after those present have drawn, shall

SEC. 9 Be it further enacted, That on the first Wednes-
day of October, in the year eighteen hundred and forty-
