shall be capable in law and equity to hold property, wheth-
er acquired by purchase, gift or devise, property real, per-

Sec. 2. Be it enacted, That the trustees for the time be-
ing shall call a meeting of the subscribers of said school as-
sociation, on the first day of March, eighteen hundred and
forty-two, and on the same day in each and every succeed-
ing year, or within thirty days thereafter, for the purpose of
electing five trustees, to be chosen by, and amongst the sub-
scribers, for the management of said school for one year
from the day of said election, and the trustees herein ap-
pointed, and who shall hereafter be elected, shall be entitled
to hold their office until a new election shall be made, they

shall have power to fill all vacancies which shall occur in
their own body until the annual election, and to take and
use all legal and proper measures for the improvement and
preservation of the school aforesaid.

Sec. 3. And be it enacted, That the trustees keep a book
or books, or cause to be kept a book or books, for the use
and property of said corporation, in which shall be duly en-
tered all the subscriptions to the use of the corporated ob-
jects, and other proceedings of said corporation, to which

of a right to vote as a member of the corporation, and the

assembled at any annual meeting; and notice of said meeting
be given in such manner as the trustees shall direct, and no
person shall be entitled to a vote who shall not have paid
two dollars to the object of said association.

Sec. 4. And be it enacted, That the said trustees and their
successors duly appointed, shall be capable in law and in
equity, to sue and be sued, to plead and be impleaded in any
court of law in this State, or before a justice of the peace,
in case the matter in controversy shall be in the jurisdiction
of the justice of the peace, and that the trustees shall have
full power in connection with the legal voters present, or a

laws for government of said school as they shall deem pro-

powered to elect at their discretion, some suitable person as
teacher of said school, and dictate and establish such rules.
