CHAP. 250.
Affidavit

county, in the same manner he could or might have done
within the time limited by law.
Sec. 2. And be it enacted, That before he proceeds to
collect under and by virtue of this, he shall make out and
deliver to the person or persons from whom the same may
be demanded, an account of the fees, sums of money or bal-
ances due from such person or persons, and if required by
the party, annex thereto an affidavit, that the same is due
and unpaid.

Sec. 3. And be it enacted, That the authority hereby
given, shall continue until the fifteenth day of May in the
year eighteen hundred and forty-three and no longer.

An act for the relief of Elijah Taylor of Baltimore County
|
Preamble.
|
Whereas, Elijah Taylor, late collector of the county
tax, for Baltimore county, by his petition to this General
Assembly, hath set forth, that he was unable to collect the
county taxes levied upon certain lands in the said county,
which belonged to Daniel Whitney, Archibald Campbell
and George Barnett, for the want of a sufficient amount of
personal property on said lands, to pay said taxes, on which
he could have levied a distress for that purpose, and that he
hath been charged with the amount of said taxes by the
commissioners of said county, and hath paid the same, and
that the said commissioners have refused to make him an al-
lowance therefor, believing that they had no power to do
so—therefore,

Be it enacted by the General Assembly of Maryland,
That the commissioners of Baltimore county aforesaid, be
and they are hereby authorized and required to re-examine
into the circumstances of the said application of the said
Elijah Taylor for an allowance to him of the amount of
county taxes so charged to and paid by him as aforesaid,
and if upon such re-examination, it shall appear that the said
taxes could not have been collected by him, and that he
used proper means and diligence to make said collections,
then and in such case, the said commissioners shall make
such reasonable allowances to the said Elijah Taylor, and
shall cause a levy of the amount thereof to be made, for his
use, upon the assessable property of the said county, and
pay the same to him when collected.
