CHAP. 194.

to arrest the person or persons so refusing or neglecting,
and carry him or them before some justice of the peace,
who may upon warrants issued for that purpose, give judg-
ment and issue execution forthwith for the said sum of twen-
ty dollars and costs which said sum shall be one-half to the
use of the constable, and the other half for the use of the

the right to stay the execution or appeal from such judgment
on giving security as in other cases of appeals.

ty.

Sec. 5. And be it enacted, That the owner, owners or
keeper of every stud horse or jackass, shall before being
permitted to stand or station such animal, pay to the clerk
of some one of the counties in this State, the highest sum
which he or they intend to ask or receive for the season of
one mare, and the receipt of the said clerk with the county
seal attached to the same, for such sum, shall be and consti-

tute the license for stationing or standing such stud horse or
jackass from one year from the date thereof, provided, that
in no case shall the sum directed to be paid by this section
for such license be less than ten dollars; and provided further,
that every stallion or jackass upon which the said tax is
levied by this section, shall be exempt from all other State
tax, and any owner, owners or keeper stationing or standing
any such stud horse or jackass, without having first com-
plied with this section of this act, shall forfeit and pay twice
the sum hereby authorized and required to be paid, one-half
for the use of the State, and the other half for the use of the
informer, and upon information being given upon oath to the
sheriff of the county, in which such animal is stationed or
standing, that the owner, owners or keeper is standing such
animal without license, it is hereby declared to be the duty
of, and the sheriff is hereby authorized and directed to dis-
train for the same by seizing such stud horse or jackass, and
making sale of the same for the amount thus forfeited.

Sec. 6. And be it enacted, That the clerks of the several
counties shall record the license so granted in accordance
with the provisions of this act, and the different amounts re-
ceived for granting the same, and shall pay over all monies
so received to the treasurer of the western shore as in like
cases is provided for by law.

Sec. 7. And be it enacted, That nothing contained in the
provisions of this act, shall be held to affect or impair the
power heretofore granted to municipal corporations in this
State, to prohibit, tax or license any of the shows or exhibi-
tions or other matters mentioned in this act; provided, that
nothing in this act contained shall be made to impose any
tax on agricultural shows or fairs.
