1841.

Asbury Peddicord of Howard district in Anne Arundel
county, in the State of Maryland, of the third part; and re-
corded on the twenty-second day of March, eighteen hun-
dred and forty-one, in Liber I. L. M. number one, folio three
hundred and twenty, and so forth, one of the land record books
of Howard district of Anne Arundel county, to be, and the
same is hereby made as valid and effectual as if the same
had been acknowledged according to the laws of this State..

CHAP. 23.

CHAPTER 23.

 

A bill entitled, an act to- prevent nuisances in or near the
town of Port Tobacco in Charles County.

Passed Jan.
21, 1842.

Section 1. Be it enacted by the General Assembly of
Maryland, That it shall not be lawful after the passage of
this act, for any person or persons to permit his, her or their
swine to go at large within the town of Port Tobacco, and
it shall be the duty of the constable of said town upon the
information of any person or upon his own view, to seize
forthwith all such swine, and to secure the same, and all and

every such swine so seized shall be forfeited and sold, after
two days notice put up at the court house door, at public
auction to the highest bidder, and one-half of the profits
arising from the sale thereof, to be retained by the said con-
stable for his trouble, and the other half to be accounted for
and rendered by the said constable to the trustees of the
primary school of the district in which said town is situated

for the use of the said school; provided, that the owner or
owners of the said swine or some person for them may with-
in one day after the seizing thereof, redeem the. same by
paving to the constable the sum of one dollar for every such
swine so seized and secured, the amount to be by him re-
tained for his trouble.

Proviso.

Sec. 2. And be it enacted, That it shall not be lawful af-
ter the passage of this act, for any person or persons to keep
or raise any swine in styes, pens or other enclosures, within
the limits of the said town or within one quarter of a mile
of the limits thereof, and it shall he the duty of the consta-
ble of said town, upon the information of any person or upon
his own knowledge, that any person or persons has or Have
any swine confined in any stye, pen or any enclosure, with-
in the limits of said town or within a quarter of a mile of
