CHAPTER 143.

CHAP. 144.

An act for the protection of Fish, in the Patuxent River,
and its tributary streams.

28, 1843.

Section 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act, it
shall not be lawful for any person or persons, except the
citizens residing in the counties bordering on the said river
and its tributaries, or who may be permitted to do so by
persons owning or occupying lands on said river, or its tri-
butaries hereafter to erect, or cause to be erected, fixed, or
hauled in the aforementioned river, or its tributaries, any
gill net. seine, or other obstruction; and every person so
offending, and being convicted thereof before a justice of
the peace, or magistrates court, adjoining the water course
in which the offence has been committed, shall forthwith
pay the sum of twenty dollars; and he shall moreover be
deemed guilty of a nuisance, and the justice of the peace,
or magistrate shall cause the obstruction to be removed,
and in case the offender shall fail to pay the fine aforesaid,
the justice or magistrates court, as the case may be, shall
take the gill net, seine, and boat, together with the fishing
tackle and apparatus, and all things on board at the time and
sell the same to the highest bidder, after' five days notice.

Sec. 2. And be it enacted, That after the payment of
costs of prosecution of offenders under this law, the balance
arising from the fine and sale of the boat, seine and other
articles herein before mentioned, shall be apportioned in
the following manner to wit: one fourth thereof to the
sheriff or other officer making the arrest or seizure, and the
balance among those whom he may have summoned, and
who have aided in the same.

A further additional supplement to an act entitled, an act
to provide for the repair of the Public Roads, in Mont-
gomery County.

28, 1842.

Section 1. Be it enacted by the General Assembly of
Maryland, That the commissioners for Montgomery coun-
ty, be authorized and required to appoint annually, in the
month of April, such number of supervisors for the several
election districts of said county, as they in their discretion
may think the public interest requires, and to fill at any
