LAWS OF MARYLAND.

CHAP. 162.

said, the said treasurer may proceed to collect the same as
county taxes are now collected, and it shall be the duty of
the treasurer to pay over to the order of the trustees as
aforesaid, all such sums as may have been received by him
from time to time, and to keep a proper account, and to
make a regular report of the same to the trustees as afore-
said annually, or when called for.

SEC. 5. And be it enacted, That any person residing out
of school district, number three, shall, by paying such tax
as the trustees of said school may direct, so that the same
shall be in proportion to those taxed within the district, (if
so desiring) may send his or her children, as the case may
be, and be entitled to the same advantages as if in the dis-
trict, to all intents and purposes.

Meeting to ap-
point trustees.

SEC. 6. And be it enacted, That as soon after the passage
of this act, as the taxable persons within district school,
number three, may deem it necessary that public notice
shall be given throughout the district, for a meeting to be
held at the school house, in district number three, at which
time the said taxable persons, or a majority of them, shall
appoint seven trustees as aforesaid, whose duties are pre-
scribed in the second and third sections of this act.

Make by-laws.

Proviso.

SEC. 7. And be it enacted, That the trustees so appointed
shall have full power to pass such by-laws for the promo-
tion and good government of said school, as they in their
judgment may think right and proper; provided, the same
shall not be inconsistent with or repugnant to the constitu-
tion and laws of this State.

School to be
free.

SEC. 8. And be it enacted, That when district school,
number three, as aforesaid, shall be permanently establish-
ed, it shall, and is hereby declared a free school, for all the
white citizens in the district as aforesaid, or those out of
the district, who shall comply with the provisions of this
act.

Vacancies.

SEC. 9. And be it enacted, That the trustees, or a majo-
rity of them, shall have lull power to fill any vacancy that
may occur in their body, by death, removal, resignations or
disqualifications, as the case may from time to time occur.

Repeal of in-
consistent acts.

SEC. 10. And be it enacted, That any act heretofore pass-
ed, which is inconsistent with the provisions of this act, so
far as relates to district school, number three, in the upper
district of Caroline county, be and the same is hereby
repealed.
