1840.

them, are hereby authorised to pay, or cause to be paid, to
the order of the trustees of district school, number three, in
the upper district of Caroline county, as hereinafter provi-
ded for, all their just proportion of the Free School Fund,
the State's Donation, and the Surplus Revenue Fund, from
time to time, as may be due to Caroline county, as is now
provided for, and all their portion of whatever Free School
Fund may appear due to the upper district of Caroline
county at this time, and the same shall be consolidated and
considered as a permanent fund, so far as relates to district
school, number three, in the upper district of Caroline coun-
ty, as may appear from the books of the orphans' court of
said county.

CHAP. 162.

To be made a
permanent fund

SEC. 2. And be it enacted, That the trustees hereinafter
to be provided for before they shall act as such, shall pro-
duce a copy of the proceedings by which they were ap-
pointed to the orphans' court of the county aforesaid, and
subscribe to the following oath, to be administered by one
of the said court: we do solemnly swear or affirm, as the
case may be, that we will in all things appertaining to dis-
trict school, number three, in the upper district of Caroline
county, discharge our duty as trustees, honestly and with
fidelity, and that we will cause a true copy to be kept of all
the proceedings of said school, and cause a regular report
to be made annually to the orphans' court aforesaid, of all
the monies received and paid away, and to see that the said
school is well conducted, and that ample justice is done to
all the children who may be given in charge to said school.

ken by trustees.

SEC. 3. And be it enacted, That the trustees hereafter
to be provided for, shall, when appointed, have full power
to lay such tax on the taxable property within school dis-
trict, number three, from time to time as may be necessary
to establish and make permanent said school, in addition to
the fund received from the State; provided, the same shall be
levied in the same proportions as county taxes are; and the
trustees so appointed, shall select from among the taxable
persons of the district a suitable person, as treasurer, who
shall give a bond approved by the trustees, for the faithful
performance of his duty; which bond shall be filed in the
orphans' court of said county annually.

SEC. 4. And be it enacted, That the treasurer so appoin-
ted shall have full power to collect such sums from the tax-
able persons in the district, as may be directed by the trus-
tees as aforesaid, and it shall be his duty to give each
person thirty days notice of the levy of said tax, and at the
same time to state the amount due; and in the event of any
of the persons notified as aforesaid, failing to pay as afore-
