nated, shall hereafter be known as the south-western line
of the fifth election district in said county.

CHAP. 139.

SEC. 2. And be it enacted, That all acts or portions of
acts, inconsistent or repugnant with the provisions of this
act, be and the same are hereby repealed.

CHAPTER 138.

Repealed

A supplement to an act, entitled an act to prevent Obstruc-
tion in Smith's, and other Private Docks, in the City
of Baltimore.

Passed Feb. 26,

1841.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall not be lawful for any vessel to
enter Smith's dock, without first ascertaining whether there
is a vacant place at the wharf where she can lie, Hinder a
penalty of five dollars.

SEC. 2. And be it enacted, That all vessels which shall
be found obstructing the passage of said dock, shall re-
move when requested by the master or agent of the pas-
sing vessel, in such manner as shall give a free and unob-
structed passage to the said passing vessel, under a penalty
of five dollars per hour, for each and every hour they shall
obstruct the passage of such passing vessel, after due no-
tice shall have been given to the master, owner or whoever
may be in charge of said obstructing vessel.

SEC. 3. And be it enacted, That the said penalties may
be recovered as other small debts, before a single justice
of the peace of the city of Baltimore, from the master,
owner or person in charge of said obstructing vessel, for
the use of the master, owner or person in charge of the
passing vessel, and obstructed as aforesaid; provided, that
if the obstruction proceeds from any unavoidable cause,
than the penalty hereby imposed shall not be incurred.

CHAPTER 139.

Recovery of
fines.

An act to incorporate the Baltimore Hebrew and English
Benevolent Academical Association.
