1840.

sioners of the county aforesaid, in the month of March
last, levied a tax upon the assessable property of the
whole county, in order to pay the county charges; and
doubts are now entertained whether the commissioners of
Anne Arundel county have authority to pay to the commis-
sioners of Howard district, a proportion of said tax when
collected, and what is the sum which the commissioners
last mentioned are entitled to receive — therefore,

CHAP. 135.

SECTION I. Be it enacted by the General Assembly of
Maryland, That Thomas H. Dorsey, James H. Watkins
and Alexander Randall; Thomas Hood, George Cooke
and Edwin P. Hayden, be and they are hereby appointed
commissioners to ascertain the sum which remains due and
unpaid, to the commissioners of the said Howard district
as aforesaid; and upon the same being ascertained, the com-
missioners of Anne Arundel county are hereby authorised
and directed to pay the same.

SEC. 2. Be it enacted, That if the commissioners so
named as aforesaid, shall not be able to agree upon the sum
to be paid to the commissioners of Howard district, they
have authority to appoint a seventh person to. decide the
matters in dispute, between the commissioners above ap-
pointed; and upon a determination being had in the premises,
a certificate of the proceedings of said commissioners, and
their determination as aforesaid, shall be filed with the
clerk of the commissioners of Howard district, and a copy
thereof shall be transferred to the clerk of the commis-
sioners of Anne Arundel county, to be filed by him with
the papers and proceedings of the said commissioners.

Shall appoint a

SEC. 3. And be it further enacted, That the commis-
sioners before named, shall receive the same compensation
for their services, which is now allowed to the commis-
sioners of tax for Anne Arundel county and Howard dis-
trict; and that Anne Arundel county and Howard district,
shall each pay one half of the expense.

CHAPTER 135.

Compensation.

An act for the relief of James Percey, of Allegany
County.

Passed Feb. 27,
1841.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act,
James Percy, of Allegany county, be and he is hereby au-
thorised and empowered to enclose that part of the Cum-
