SEC. 4. And be it further enacted, That the Commis-
sioners of Betterton are hereby authorized and empowered
to construct, establish, design, extend, maintain and oper-
ate a sewage treatment disposal plant and sanitary sewer-
age system, and shall have authority to acquire by gift,
purchase, lease or condemnation all lands either in fee
or as an easement, and any water rights necessary there-
for. Whenever resort shall be had to acquisition by con-
demnation the proceedings shall be instituted under
Article 33A, title "Eminent Domain", of the Annotated
Code of Maryland, Edition of 1939, and all amendments
thereto.

SEC. 5. And be it further enacted, That the Commis-
sioners of Betterton shall cause surveys, studies, plans,
specifications and estimates to be made for the establish-
ment and construction of a sanitary sewerage system and
a sewage treatment plant for the town of Betterton which
may be located and established within or without the cor-
porate limits of said town. Whenever plans shall have
been completed for this project, or any part thereof, and
shall have been approved by the State Board of Health,
and the Commissioners of Betterton shall have decided to
proceed with the construction thereof, they shall adver-
tise by notice in such newspapers or technical press as
they may deem proper for bids for the construction of
said work, in part or as a whole, as in their judgment
may appear advisable. The contract shall be let to the
lowest responsible bidder or the said Commissioners may
reject any and all bids, and, if in their discretion the
prices quoted are unreasonable, they may readvertise the
work, or any part of it, or may award said contract on a
negotiated basis, or may do any part or all of the work
by day labor; provided, that at any time the said Com-
missioners may, in their discretion, expend by day labor
for construction work an amount not exceeding Two Thou-
sand Dollars ($2, 000. 00) without advertising or receiving
bids. All contracts shall be protected by such bonds, penal-
ties and conditions as the said Commissioners shall require,
all of which shall be enforceable in any court of competent
jurisdiction.

SEC. 6. And be it further enacted, That the Commis-
sioners of Betterton, for the purpose of establishing sewer-
age rental charges for the construction of said sewerage
system and sewage treatment plant shall divide all prop-
erty binding upon a street, lane, alley, or right-of-way in
which a sewer main is to be laid into five classes, namely:
agricultural, small acreage, industrial or business, hotel,
