(House Bill 118)
AN ACT to add a new sub-section to Section 475 of the Code
of Public Local Laws of Prince George's County, (1943
Edition—being Article 17 of the Code of Public Laws of
Maryland) title "Prince George's County", sub-title. "Dis-
trict Heights", said new sub-section to be known as sub-
section (D) of Section 475 of the Code of Public Laws of
Prince George's County, providing for the manner of the
levying and the collecting of a special assessment for street
lighting purposes, and providing for a referendum thereon.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 475 of Article 17 of the Code of Public
Local Laws of Maryland, title "Prince George's County",
sub-title "District Heights", be and it is hereby amended by
adding a new paragraph known as Paragraph (D) to read as
follows:

(D) In addition to other taxes authorized to be levied
by the Town Commissioners there is authorized to be levied,
and there shall be levied, a tax on the real estate situated
within the corporate limits of the Town of District Heights,
to be known as the Street Lighting Tax, at such rate as
shall be determined by the Town Commissioners to be neces-
sary to defray the cost of providing and maintaining ade-
quate street lighting within the town, but in no event to
exceed the rate of Ten Cents ($0. 10) per One Hundred Dol-
lars ($100. 00) of assessed valuation of such real estate, based
on the assessed value thereof as fixed by Prince George's
County for tax purposes, provided, that all monies received
or collected by reason of such tax levy shall be deposited in
a separate fund to be known as STREET LIGHT FUND, and
further provided, that the Street Light Fund shall be avail-
able for, and expended for, the purpose of providing and
maintaining adequate street lighting, and for no other pur-
pose. In the event that funds of the Town of District
Heights, other than the Street Light Fund, are available or
shall become available for the purpose of defraying the cost
of maintaining the street lighting within the town, in whole
or in part, the Town Commissioners are authorized to reduce
the rate of the Street Lighting Tax theretofore levied and
in the event that such other funds of the town are available
in sufficient amount to defray the entire cost of maintaining
the town street lighting, then the Street Lighting Tax shall
