or from either spouse individually to their joint names, when-
ever the owner of a registered vehicle transfers or assigns
his title, or interest thereto, the registration of such vehicles
shall expire unless said owner shall give to the purchaser
written permission to use said registration plates for a
period of ten days from the date of transfer; in case such
permission be not given the owner shall remove the registra-
tion plates therefrom and may have such plates and the regis-
tration number thereon assigned to another vehicle upon pay-
ment of a fee of One Dollar ($1. 00) where such motor vehicle
is of less or equal horsepower, tonnage, or chassis weight as
that originally registered; or upon payment of the above fee
of One Dollar ($1. 00) plus the difference between the fee
originally paid for said registration plates and that due in
case the new motor vehicle be properly registered in a higher
class.

(c) A purchaser to whom has been given written per-
mission to use original registration plates as provided by
sub-section (b) of this section shall remove said regis-
tration plates at the expiration of such ten days and
promptly return them either to the original owner of the
motor vehicle or the Department and it shall be unlawful for
the purchaser or any person other than the person to whom
such registration plates were originally issued to have the
same in his possession after the expiration of such ten days
whether in use or not; provided however that nothing in this
sub-section shall be construed to prohibit the original owner
from transferring said registration plates to another vehicle,
as hereinbefore provided.

(d) Whenever the owner of any registered vehicle trans-
fers or assigns his title, the owner shall also endorse an
assignment and warranty of title upon the certificate of title
for such vehicle with a statement of all liens or encumbrances
thereon, which statement shall be verified under oath by the
owner, and he shall deliver the certificate of title to the
purchaser or transferee at the time of delivering the vehicle,
except as hereinafter provided.

Violation of this section shall be deemed a misdemeanor
and upon conviction shall be punishable by a fine of One
Dollar ($1. 00) to One Hundred Dollars ($100. 00).

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.
