the Annotated Code of Maryland (1947 Supplement), title
"Justices of the Peace", sub-title "Trial Magistrates Sys-
tem", relating to substitute Trial Magistrates in Montgom-
ery County.

I am vetoing this Bill because the title is defective. The
title states that the Bill relates to substitute trial magistrates
in Montgomery County, while the Bill in fact increases the
salaries and expense funds of the. deputy sheriffs.

MORTGAGES

SENATE BILL No. 228.

AN ACT to repeal Sections 6 to 16, inclusive, of Article 66
of the Annotated Code of Maryland (1939 Edition), title
"Mortgages", and to enact in lieu thereof 11 new sections,
to be known as Sections 6 to 16A, inclusive, of said Article
66 and to follow immediately after Section 5 thereof, com-
bining and standardizing the procedure for the foreclosure of
mortgages in Baltimore City and the counties of this State;
and to repeal Sections 840 to 855, inclusive, of Article 4 of
the Code of Public Local Laws of Maryland and Baltimore
City Charter (1938 Edition), title "Baltimore City", sub-
title "Mortgages", said sections relating generally to the
foreclosure of mortgages.

This Bill as originally drawn and recommended by the Bar
Associations made the law relating to the foreclosure of mort-
gages by assent to the decree prevail throughout the State
instead of only in Baltimore City. It was also intended in
Section 16 to introduce a limitation as to mortgages unpaid
for twenty years.

However, Section 16 was amended to provide that all mort-
gages would be invalid unless re-recorded every twenty years.
This provision is unfortunate and could be most harmful.
There are many G. I. and F. H. A. mortgages that will run for
twenty-five or thirty years, and, of course, indentures securing
bond issues run for much longer periods.

There is a serious question as to the constitutionality of a
law which invalidates a lien by mere lapse of time.

For these reasons the Bill has been vetoed.
