prospective employees to secure a medical examination
under certain conditions.
The provisions of this Bill are, in my opinion, unnecessary
and I have vetoed it.
LAV ALE SANITARY DISTRICT
HOUSE BILL No. 608
AN ACT to repeal and re-enact, with amendments, Section
380A of Article 1 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Allegany County", sub-title
"Lavale Sanitary Commission", to repeal Section 380F of
said Article and sub-title and to enact a new Section 380F
in lieu thereof, said sections having been enacted by Chapter
13 of the Acts of the Special Session of 1947, relating to
the boundaries within the jurisdiction of the Lavale Sanitary
Commission in Allegany County, and relating to the appoint-
ment of the members of the said Commission.
This Bill seeks to repeal and re-enact sections of Chapter 13
of the Acts of the Special Session of 1947, which created the
Lavale Sanitary Commission in Allegany County.
Under the provisions of Chapter 13 the boundaries of the
Sanitary District were specifically described. A successful
referendum on the law was held, and thereafter the validity
of the law was upheld in the courts.
Under the terms of this Bill specific boundaries of the dis-
trict are repealed and the limits thereof are defined as con-
sisting "of all that part of Allegany County, Maryland, gen-
erally known as 'La Vale7, as defined by resolutions as drafted,
and amended from time to time, by the Board of County Com-
missioners of Allegany County7'. The Board of County Com-
missioners have authority to change the boundaries from time
to time.
The Bill does not set up any reasonably definite standard
by which the boundaries of the district could be established,
and with authority to thereafter change such boundaries as
might be established, the right of the residents of the district,
established under Chapter 13, is obviously frustrated.
For these reasons the Bill has been vetoed.
