at any place within the corporate limits of Hagerstown
for park purposes; provided, that any such condemnation
proceedings shall be instituted under the general laws of
the State of Maryland. And the said City of Hagerstown
is hereby authorized and empowered to levy a sum of
money upon the assessable property of Hagerstown, suffi-
cient to pay for said land for park purposes, at the time
of the making of the annual levy for taxes by the Council
and to be included therein.
92. The City of Hagerstown shall have all powers that
are incident to and necessary for the operation of the muni-
cipal parks system, and these powers shall include the
right to pass all ordinances not inconsistent with the
powers herein granted that may be necessary for the pro-
tection and preservation of said parks, and to attach
reasonable penalties thereto for violations thereof, and
from time to time to repeal, alter and amend any such
ordinances.
93. There is hereby created and continued a Board of
Park Commissioners of five members. The five members
of the Board of Park Commissioners in office at the time
of the adoption of this Charter shall continue in office and
each shall serve out the term of appointment. On or
before the 1st day of March in any year in which the term
of office of any member is to expire, the Mayor with the
advice and consent of the Council shall appoint one person
as a member of such Board in the place and stead of any
person whose term has expired to serve for a term of three
years or until his successor is appointed and qualified. The
Board of Park Commissioners shall possess and shall be
charged with the exercise 'and any and all powers of the
City of Hagerstown incident to the management, control
and supervision of the Parks of the City of Hagerstown.
Vacancies in said Board shall be filled by the Mayor with
the advice and consent of the Council.

SEWERAGE
94. The City of Hagerstown shall have power to own,
operate, and maintain a sewerage system, as at present
established or as hereafter to be established by the County
of said City. The Council is authorized and empowered to
pass all ordinances necessary to provide for the operation,
management, maintenance, enlargement and improvements
of said sewerage system, and to acquire property for use
in said sewerage system by purchase, lease, or condemna-
