1798 LAWS OF MARYLAND. [CH. 723

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
of the General Assembly of Maryland, the same shall take
effect from the date of its passage.

CHAPTER 723

(House Bill 389)

AN ACT to repeal and re-enact, with amendments, Section
128 and Sub-section (k) of Section 135 of Article 2B of the
Annotated Code of Maryland (1947 Supplement), title
"Alcoholic Beverages", sub-title "Boards of License Com-
missioners'7, relating to the salary and expense account of
the License Commissioner of Frederick County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 128 and Sub-section (k) of Section 135 of
Article 2B of the Annotated Code of Maryland (1947 Supple-
ment), title "Alcoholic Beverages", sub-title "Boards of
License Commissioners", be and they are hereby repealed
and re-enacted, with amendments, to read as follows:

128. APPOINTED BY GOVERNOR, (a) (Frederick County. )
In Frederick County, the Governor shall appoint a License
Commissioner for Frederick County, who, at the time of his
appointment, shall be a resident and taxpayer of Frederick
County and shall have resided in said County for not less
than five years next preceding his appointment and be not
less than thirty years of age. During his term of office, he
shall not hold any other position of trust or profit under the
laws of the United States or the State of Maryland. In addi-
tion to his salary, the County Commissioners shall provide
him with such sum as may be necessary to cover office and
other expenses not exceeding Fifteen Hundred Dollars
($1, 500. 00) per annum. The Commissioner so appointed shall
constitute the Board of License Commissioners for Frederick
County.

135.

(k) (Frederick County. ) In Frederick County the License
Commissioner shall receive a salary of Twenty-four Hundred
Dollars ($2, 400. 00) per annum.
