emergency, or who is called thereto in temporary service or on
reserve duty and who because of such induction, enlistment or
calling leaves his position in the Classified Service, other than
a temporary position, shall be restored to his former position.
Application therefor must be made within forty days follow-
ing his release from such service in the armed forces of the
United States. Such reinstatement shall be contingent upon
the applicant's having a certificate of honorable discharge
from the armed forces, and upon his being still qualified to
perform the duties of his former position. Upon reinstate-
ment, the time spent by such person in the armed forces
shall be added to his seniority, he shall be entitled to the
same pay as persons having the same seniority and doing the
same kind of work are receiving, and he shall be restored
to the position in the Classified Service held by him at the
time he entered the armed forces, as if his employment in the
Classified Service had not been interrupted.

84. VACATIONS AND SICK LEAVE, (a) Every person
in the Classified Service shall be entitled to a vacation of
fifteen days with pay, after one year of service.

(b) Every person in the Classified Service shall be allowed
leave of absence with pay, on 'account of sickness, up to fif-
teen days in any one year, with the right to accumulate un-
used sick leave from year to year, up to sixty days, and to
use the same for sick leave at any time.

85. PENSIONS, (a) The Mayor and City Council are
authorized and empowered to establish and maintain a pen-
sion and retirement system for all officers and employees of
the City, including those in the Unclassified Service as well
as those in the Classified Service. Any such system shall be
operated on an actuarial basis, to be financed by the joint
contributions of the City and of the members, and to have
sufficient reserves on the basis of approved mortality and
service tables to meet its obligations. The provisions of any
ordinance creating and establishing such a pension and re-
tirement system shall be administered by a Pension Board of
three persons to be appointed by the Mayor and City Council.
Each such person shall receive a salary of $100. 00 per year.
Of the persons first appointed to such Board, the terms shall
be set at two, four and six years, with the appointee to the
longest term to act as Chairman. Thereafter all appoint-
ments shall be for terms of six years, and the member oldest
in point of service shall act as Chairman. Every such ap-
pointee must have lived in the city for at least three years
at the time of his appointment and must continue to reside
therein during his time of service.
