(b) In the alternative, the Mayor and City Council may
provide for the officers and employees of the City becoming
members of the State Employees7 Retirement System, agree-
ably to the provisions of Article 73B, Sections 17-24 of the
Annotated Code of Maryland (1947 Supplement).

86. APPOINTING OFFICER. The Appointing Officer
shall be the City Manager, with duties as prescribed in this
Article.

87. PENALTY. Any violation of any of the provisions of
this Article relating to the Civil Service Commission, or any
wilful use of any corrupt means in connection with any
examination, appointment, promotion, reduction, transfer or
reinstatement, shall be deemed a misdemeanor, and upon con-
viction in a Court of competent jurisdiction shall be punished
by a fine of not more than Five Hundred Dollars, or by im-
prisonment for not exceeding one year, or both such fine and
imprisonment in the discretion of the Court.

CIVIL SERVICE COMMISSION

88. MEMBERS. There shall be a Civil Service Commis-
sion, composed of three Civil Service Commissioners. The
Mayor and City Council shall appoint a Commissioner on the
first Monday in April of every even numbered year, to suc-
ceed the Commissioner whose term is then expiring, and each
such appointee shall serve for a period of six years or until
his successor has been appointed and has qualified. Vacan-
cies for any cause shall be filled by the Mayor and City Coun-
cil for the unexpired term.

89. QUALIFICATIONS. Each Commissioner shall have
been a citizen of Maryland and a resident of the City for at
least three years next preceding his appointment. No person
who is a Commissioner shall at the same time hold or be a
candidate for any office of public trust, or solicit or give any
contribution to aid in the campaign or election of any candi-
date for a municipal office in the City.

90. OATH OF OFFICE. Each such appointee shall
qualify for his position by taking an oath of office, to be kept
and filed in the office of the City Clerk, that he will support
the Constitution of the United States and of the State of
Maryland, obey the provisions of this Article, and maintain
honesty and efficiency in the Classified Service of the City,
free from partisan distinction or control or other discrimina-
tion.
