1654 LAWS OF MARYLAND. [CH. 687

Racing Commission as created by Chapter 786, Laws of
1947, and all fines and penalties and overpayments on the
tote machines hereafter collected, except such fines and
penalties as may be imposed upon Associations. Such
fines, penalties and overpayments shall be collected by the
Clerk of the course and shall be paid to the Maryland
Racing Commission within ten days after the close of
each race meet and shall be paid by the Commission to
Maryland Horsemen's Assistance Fund, Inc., on or before
December 31 in each year, provided that no payments
shall be made by the Commission to Maryland Horsemen's
Assistance Fund, Inc., unless the Commission, in its dis-
cretion, is satisfied that said Corporation is, in all respects,
being operated for the above-mentioned charitable and
benevolent purposes, as set forth in its original charter,
and that no part of the funds paid to said Corporation by
the Commission or any net earnings of said Corporation
inure to the benefit of any private individual, director,
officer or member of said Corporation.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1949.

CHAPTER 687
(Senate Bill 407)

AN ACT to repeal and reenact with amendments Sections
240, 241, 246, 251 and 251B of Article 56 of the Anno-
tated Code of Maryland (1939 Edition and 1947 Supple-
ment), title "Licenses", and to change the sub-title
"Gasoline Tax" to "Motor Vehicle Fuel Tax', and to add
two new Sections to said Article to be known as Sec-
tions 251C 'and 260, said Section 251C to follow imme-
diately after 251B and said Section 260 to follow im-
mediately after Section 259 of said Article relating to
the imposition and collection of Motor Vehicle Fuel Tax
including the tax on diesel fuel oil.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 240, 241, 246, 251 and 251B of Article 56 of
the Annotated Code of Maryland (1939 Edition and 1947
Supplement), title "Licenses", sub-title "Gasoline Tax", be
and are hereby repealed and reenacted, with amendments,
and the sub-title "Gasoline Tax" be and it is hereby
