CHAPTER 625
(House Bill 677)

AN ACT to add a new section to the Anne Arundel County Code
(1947 Edition), being Article 2 of the Code of Public Local
Laws of Maryland, title "Anne Arundel County", sub-title
"Licenses", said new section to be known as Section 390A
and to follow immediately after Section 390 of said Code,
relating to the authority of the County Commissioners of
Anne Arundel County to examine all applicants for li-
censes authorized to be issued under this sub-title and the
places where said businesses or events are to be operated
and to authorize said commissioners to appoint a person
or persons to exercise said powers in their stead.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to the Anne
Arundel County Code (1947 Edition), being Articled of the
Code of Public Local Laws of Maryland, title "Anne Arundel
County", sub-title "Licenses", said new section to be known
as Section 390A and to follow immediately after Section
390 of said Code, and to read as follows:

390A. The Board of County Commissioners of Anne Arun-
del County, or the person or persons appointed by said Board
for this purpose, shall examine all applicants for licenses
issued under the authority of Sections 383 to 390, inclusive,
of this Article (including Bingo) and shall examine all
places in which said proposed licensed event or business is
to be operated. The said Board of County Commissioners
in its discretion shall have the power to appoint a person
or persons to exercise the authority conferred on said Board
by this section. If the Board or person or persons appointed
by said Board for this purpose find that the applicant is not
a fit person to receive the license applied for or that the
operation of the business, if the license is granted, will un-
duly disturb the peace of the residents of the neighborhood
in which the place of business is to be located or that the
operation of the proposed business or event will constitute
a nuisance, then the application shall be disapproved and
the license applied for shall be refused. The approval of all
licenses (including Bingo) issued under the provisions of
Sections 383 to 390 of this Article by the Board of County
Commissioners or the person or persons appointed by said
Board for this purpose, shall be a prerequisite to the issuance
or re-issuance of any such license by the Clerk of the Circuit
Court of Anne Arundel County. The decision of the Board
of County Commissioners or the person or persons appointed
