1436 LAWS OF MARYLAND. [CH. 591

title "Frederick County", sub-title "Frederick City", sub-
heading "Streets", said new section to be known as Section
270A, relating to the condemnation by The Mayor and
Aldermen of Frederick of a parcel of land, with appurte-
nances thereon, needed for street purposes, including any
area needed for pavement and slope-area for the grade,
through the grounds of the Frederick High School, said
parcel of land being owned by the Board of Education of
Frederick County.

SECTION 1. Be It enacted Toy the General Assembly of Mary-
land, That a new section be added to the Charter of The Mayor
and Aldermen of Frederick, specifically to Article XI of the
Code of Public Local Laws of Maryland (1930 Edition), title
"Frederick County", sub-title "Frederick City", sub-heading
"Streets", said new section to be known as Section 270A, and
to read as follows:

270A. The Mayor and Aldermen of Frederick are hereby
empowered to condemn, in accordance with Sections 269
and 270 of Article XI of the Code of Public Local Laws of
Maryland (1930 Edition), title "Frederick County", sub-title
"Frederick City", sub-heading "Streets", a parcel of land
with the appurtenances thereon now known as the Frederick
High School Grounds and owned by the Board of Education
of Frederick County, lying immediately adjacent to a stream
known as Carroll Creek and those lands now owned by The
Mayor and Aldermen of Frederick, said right of condemna-
tion herein given including that area needed for the street,
pavement, and slope areas for the grade. The land herein,
authorized to be condemned shall not exceed sixty (60) feet
in1 width and eleven hundred and sixty (1160) feet in length
of that 33 acre parcel of land, more or less, acquired by the
Board of Education of Frederick County from Jacob A. Kid-
wiler and Fannie E. Kidwiler, his wife, by deed bearing date
the Sixteenth day of November, Nineteen Hundred and
Thirty-eight and recorded in Liber No. 414, Folio 357, one of
the Land Records of Frederick County, and lying immedi-
ately adjacent to that land conveyed to The Mayor and Alder-
men of Frederick by the Board of Education of Frederick
County by deed bearing date the Sixteenth day of Decem-
ber, Nineteen Hundred and Thirty-eight and recorded in
Liber No. 414, Folio 568, one of the Land Records of Frederick
County.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.
