or wholesale, any canned tomatoes to which may be added
tomato juice or juices only from other sound tomatoes, or
goods purporting in any way to be canned tomatoes to which
may be added tomato juice or juices only from other sound
tomatoes; or having anything on the label or advertising in
any way likely to deceive prospective customers with believ-
ing that they are canned tomatoes to which has been added
tomato juice or juices only from other sound tomatoes, if such
canned tomatoes, tomato juice or juices only from other sound
tomatoes have had at any time any liquid substance of any
kind whatever introduced into the cans, except the juice or
juices arising from tomatoes after they have been properly
peeled, trimmed, cored and prepared for canning as food or
juice from other sound tomatoes as provided in Section 234.

237. Any person, firm or corporation, or the agent of any
person, firm or corporation violating the provisions of this
sub-title relative to the manufacture or canning of tomatoes
to which has been added tomato juice or juices only from
other sound tomatoes, or the selling or offering for sale by
wholesale of canned tomatoes to which has been added tomato
juice or juices only from other sound tomatoes, shall, upon
conviction, be guilty of a misdemeanor and be fined not less
than One Thousand Dollars ($l, 000. 00) for the first offense
and not less than Five Thousand Dollars ($5, 000. 00) for each
succeeding offense.

238. Any person, firm or corporation, or the agent of any
person, firm or corporation violating the provisions of this
sub-title relative to, the sale or the offering for sale at retail
of canned tomatoes or goods purporting to be canned tomatoes
to which has been added tomato juice or juices only from
other sound tomatoes, shall, upon conviction, be fined not
less than One Hundred Dollars ($100. 00) for each and every
offense.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.
