immediate preservation of the public health and safety^ and
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
of the General Assembly of Maryland, the same shall take
effect from the date of its passage.

CHAPTER 590

(House Bill 583)

AN ACT to repeal and re-enact, with amendments, Sections
234-238, inclusive, of Article 43 of the Annotated Code of
Maryland (1939 Edition), title "Health", sub-title "Toma-
toes7', relating to the canning of tomatoes with puree and/or
tomato juices from other sound tomatoes.

SECTION 1. Be it enacted by tine General Assembly of Mary-
land, That Sections 234-238, inclusive, of Article 43 of the
Annotated Code of Maryland (1939 Edition), title "Health",
sub-title "Tomatoes", be and they are hereby repealed and
re-enacted, with amendments, to read as follows:

234. It shall be lawful for any person, firm or corporation
to can or prepare in any way at any plant or factory of any
kind in this State, tomatoes with the juice or juices arising
from the said tomatoes themselves after they have been prop-
erly peeled, trimmed, cored and prepared for canning as food,
or in their discretion, to can or prepare in any way tomatoes
with tomato juice or juices only from other sound tomatoes,
provided appropriate label declarations as required by Fed-
eral Regulations are attached to such cans.

235. It shall be unlawful for any person, firm or corpora-
tion to can or prepare in any way any goods or vegetable prod-
uct purporting to be canned tomatoes to which may be added
tomato juice or juices only from other sound tomatoes, or
having anything on the label or advertised in any way likely
to deceive prospective customers with believing that they are
canned tomatoes to which may be added tomato juice or juices
only from other sound tomatoes, except in accordance with the
provisions of the preceding section.

236. It shall be unlawful for any person, firm or corpora-
tion to sell or offer for sale within this State, either by retail
