CHAPTER 117
(Senate Bill 276)

AN ACT to repeal Sections 227 to 478 (A) of Article 22 of
the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Washing-ton County, " sub-title "Hagers-
town, " and all additions and amendments thereto, the
same comprising the corporate charter of the city of
Hagerstown and to enact in lieu thereof 111 new sections
to stand in the place and stead of the sections so repealed
and to constitute the municipal charter of the city of
Hagerstown, establishing a form of municipal govern-
ment and relating generally to the government, powers
and duties of the city of Hagerstown and submitting
this Act to a referendum of the voters of said city.

SECTION 1. Be it enacted 'by the General Assembly of Maryland,
That Sections 227 to 478 (A) of Article 22 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Wash-
ington County, " sub-title "Hagerstown, " be and the same
are hereby repealed and that 111 new sections be and the
same are hereby enacted in lieu thereof to stand in the
place and stead of the sections so repealed and all to read
as follows:

INCORPORATION AND GENERAL
GOVERNMENT

1. The inhabitants of Hagerstown, in Washington Coun-
ty, Maryland, are created a corporation toy the name of
"The City of Hagerstown", and by that name shall have
perpetual succession; may sue and be sued; may have and
use a common seal, and possess such other incidents and
powers as attached by law to a municipal corporation, and
may acquire by purchase, gift, condemnation, or in any
other lawful manner, real, personal and mixed property,
and also any rights or interest therein, which in the opin-
ion of the Council it may be advisable to so acquire for
municipal purposes, provided, however, that the Mayor and
Council shall not expend for the acquisition of property
for any one purpose an amount in excess of $100, 000. 00
without the approval of the majority of voters of the City
of Hagerstown voting thereon given upon referendum at
a General or Special election of the voters of the City of
Hagerstown, and, provided, that unless otherwise stipu-
