SEC. 2. And be it further enacted, That if any part,
section, paragraph, clause, sentence or provision of this
Act or any application thereof is held invalid or any rea-
son, the remainder of this Act, and any applications thereof
shall not be affected thereby and to this end the provisions
of this Act are declared to be severable.
SEC. 3. And be it further enacted, That all laws or
parts of laws inconsistent with the provisions of this Act
be and the same are hereby repealed to the extent of such
inconsistency.
SEC. 4. And be it further enacted, That this Act shall
take effect June 1, 1945.

CHAPTER 762.
(Senate Bill 340)
AN ACT to authorize the Board of Public Works to apply
any excess receipts above a specified surplus for the
fiscal years ending June 30, 1945, and June 30, 1946,
to the State debt and to reduce the State Tax on real
and personal property and/or the State income tax for
such fiscal years or to dedicate such surplus or any part
thereof to a post-war construction fund.
WHEREAS, real estate now bears a heavy and dispropor-
tionate share of the tax burden in this State; and
WHEREAS, the State should therefore help to alleviate
this condition by reducing the State real estate tax when-
ever possible; therefore
SECTION 1. Be it enacted by the General Assembly of Maryland,
That if the revenues derived from the State Income Tax
and other sources of revenue, including the surplus carried
over from the preceding fiscal year for the fiscal years
ending June 30, 1945, and June 30, 1946, exceed the appro-
priations for each of said years, as contained in the State
Budget for said years, by more than Two Million Dollars
($2, 000, 000. 00), the Board of Public Works, in its discre-
tion, may by a resolution dedicate all or any part of such
excess revenues to the payment of the interest and princi-
pal of the State debt payable during each of the fiscal years
