tion", relating to distribution where non-resident beneficiary
shall die before receiving his share.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 140 of Article 93 of the Annotated Code of
Maryland (1939 Edition), title "Testamentary Law", sub-title
"Distribution", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

140. If any person entitled to distribution shall die before
the same shall be made, his or her share shall go to his or her
representatives. If any non-resident entitled to distribution
shall die before receiving the same and no personal representa-
tives shall have been appointed for such non-resident in this
State, his or her share may, in the discretion of the Orphans'
Court having jurisdiction of the administration, be paid or
turned over to his or her legal representative in the State, dis-
trict or territory of which he or she was a resident, upon peti-
tion by such legal representative verified by affidavit. The
petition shall set forth the entire amount of the property of
such deceased non-resident beneficiary, including his or her
property in this State, and shall be accompanied by a duly
authenticated copy of the record of the appointment or quali-
fication of such legal representative and of the bond or other
instrument or security given by him. The sufficiency of the
security shall be certified by the chief clerk or prothonotary
of the Court by which said security was taken.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.

CHAPTER 64.

(Senate Bill 48)

AN ACT to repeal Section 106 of Article 21 of the Annotated
Code of Maryland (1939 Edition), title "Conveyancing", sub-
title "Defective Conveyances", said section relating to the
validation of certain defective conveyances made prior to
1908.

WHEREAS, the provisions of Sections 102, 103 and 107 of
Article 21 amply provide for validating all defective, convey-
ances, thereby making this section unnecessary; therefore
