east are for incorporation, this Act shall immediately become
effective, but in the event that a majority of the votes cast are
against incorporation, this Act shall be null and void. The
said Committee shall certify the results of this referendum
election to the Secretary of State of Maryland.
Section 33. That if this Act is adopted under the referen-
dum above provided for, then the same Committee, with the
same power of filling vacancies, shall, on or before April 18,
1945, post in five conspicuous places in each ward a type-
written or printed notice notifying all residents that said town
is incorporated and that said Judges of Election will sit at a
designated place on April 25, 1945, between the hours of two
o'clock P. M., and seven o'clock P. M., to register all voters
who had not already registered before them.
The said Committee shall post the notices of Nominating
Convention in this Act provided for, on or before April 18,
1945, notifying the residents of the town of the time and place
of the Nominating Conventions to be held on April 25, 1945;
that after said Nominating Conventions, the Committee shall
arrange to hold the municipal election for the first Mayor,
Treasurer and Councilmen in the manner and form prescribed
herein for general town elections, except that said Committee
shall canvass the votes with the Judges and Clerks, in the
event they are different persons, and publicly announce the
results thereof, and file their returns with the Town Clerk as
soon as practicable after he or she has been appointed and
qualified. The candidates for Mayor and Treasurer receiving
the largest number of votes in the town respectively, and the
candidate for councilman from each ward receiving the largest
number of votes from that particular ward for the term for
which he was nominated, whether two or four year term, shall
be declared by said Committee to be duly elected to tile respec-
tive offices, and upon their taking the oath of office they shall
become the Mayor and Town Council for said town. In case
this Act should not be approved by the Governor before April
12, 1945, the said Committee shall change the dates fixed in
this and the preceding section to approximately one month
later, on which changed dates they shall perform the enumer-
ated duties.
In case of a tie the remaining members of the Mayor and
Town Council shall order a new election for that particular
office as in this Act provided for.
The Mayor and Town Council may make their first tax levy
of not to exceed fifty cents on each f 100. 00 of assessed valua-
tion, on or before June 25, 1945, for the partial tax year end-
ing December 31, 1945, which taxes shall be due on July 1,
1945, and shall become delinquent and bear interest at the
same time as provided for town taxes generally in this Act.
