CHAPTER 402.
(Senate Bill 326)
AN ACT to repeal and re-enact, with amendments, Sections
273 and 274 of Article 93 of the Annotated Code of
Maryland (1939 Ed. ), and to repeal Section 275 of
Article 93 of the Annotated Code of Maryland (1943
Supp. ), title "Testamentary Law, " sub-title "Register
of Wills, " relating to his bond.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 273 and 274 of Article 93 of the Annotated
Code of Maryland (1939 Ed. ), title "Testamentary Law, "
sub-title "Register of Wills, " be and the same are hereby
repealed and re-enacted, with amendments, so as to read
as follows:
273. Beginning with November 5, 1946, the register
of wills in each county, before he acts as such, shall give
bond in the penal sum of fourteen thousand dollars,
payable to this State, with condition that he faith-
fully perform the duties of his office and account for
all funds received under color of his office, which bond
shall be taken and security or securities approved by the
judges of the orphans' court and recorded in the office of
the clerk of the circuit court for the county of which he
is register, and thereafter filed with the State Comptroller;
and every register shall give a new bond in like manner
on or before the first day of December of the second year
following his qualification in office.
274. On default of any register of wills to execute
any bond required by the preceding section within
the time therein prescribed, he shall be subject to a penalty
of one thousand dollars to be recovered by indictment in
the name of the State in the circuit court for the county in
which he shall reside; or, if he reside in the city of Balti-
more, by indictment in the criminal court of Baltimore.
SEC. 2. And be it further enacted, That Section 275 of
Article 93 of the Annotated Code of Maryland (1943
Supp. ), title "Testamentary Law, " sub-title "Register of
Wills, " be and it is hereby repealed.
SEC. 3. And be it further enacted, That this Act shall
take effect on June 1, 1945.
