tuted a body corporate, by the name of "The Mayor and Com-
mon Council of Deer Park"; and
WHEREAS, the said The Mayor and Common Council of Deer
Park, finding it necessary to provide a place for the dumping
of refuse accumulated and gathered in said town and no place
being available within the corporate limits of said town, pur-
chased from George Paugh and Hughie Paugh, a small parcel
of land containing three and five-tenths (3. 5) acres, located
just outside said corporate limits and on the 14th day of
November, 1944, the said George Paugh and Hughie Paugh
executed and deliver to said The Mayor and Common Council
of Deer Park, a deed for said land, and the purchase price
therefor was paid; and
WHEREAS, there appears to be some question as to the power
and authority of said municipality, under its present Charter,
to purchase and hold said land for said purpose without the
sanction of the General Assembly of Maryland, therefore
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the purchase by The Mayor and Common Council
of Deer Park from George Paugh and Hughie Paugh, of a
parcel of 'land containing three and five-tenths (3. 5) acres,
located in Garrett County, Maryland, near the corporate
limits of said town, and deed from the said George Paugh and
Hughie Paugh to the said, The Mayor and Common Council
of Deer Park for said land, bearing date November 14, 1944,
and recorded in Liber A. G. E. No. 134, folio 363, one of the
Land Records of Garrett County aforesaid, be and the same
are hereby sanctioned, confirmed and made valid, and the said
The Mayor and Common Council of Deer Park be and it is
hereby authorized and empowered to take and hold the land
embraced and described in said deed, with power to sue for
and defend the same, or sell the whole or any part thereof,
when and as the said body corporate may deem it expedient,
to the same extent as if said body corporate were an indi-
vidual.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses, of the
General Assembly, the same shall take effect from the date
of its passage.
