"Water Resources", to be under sub-title "Well Drillers",
said new sections to be known as Sections 18-38, inclusive,
and to follow immediately after Section 17 of said Article,
relating to the licensing of well drillers and the supervision
of drilling, coring, boring, digging or otherwise constructing
wells for water and other purposes.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That twenty-one ne\y sections be and they are hereby
added to Article 96B of the Annotated Code of Maryland
(1939 Edition), title "Water Resources", to be under sub-title
"Well Drillers", said new sections to be known as Sections 18-
38, inclusive, to follow immediately after Section 17 of said
Article, and to read as follows:

18. The Department of theology, Mines and Water Re-
sources, hereinafter called Department, in furtherance of its
general powers of supervision over the natural resources of
the State and their conservation for public use and in further-
ance of its specific responsibilities for the proper conservation,
allocation and development of the underground waters of the
State is hereby authorized and empowered to make effective
the provisions of this sub-title and to adopt such rules and
regulations as may be proper for this purpose; provided, how-
ever, that nothing in this sub-title shall be construed to deny
'to any municipality, county, or other political sub-division of
the State the right to adopt and enforce such additional
rules and regulations not inconsistent with the provisions
hereof, nor shall anything in this sub-title be construed to
limit the powers of the State Board of Health or of any other
State agency having jurisdiction of and supervision over the
public and potable water supplies of the State. The rules and
regulations so adopted may recognize a variation in the pri-
mary use of wells and a variation according to locality in the
manner of construction and of the materials penetrated.

19. No person shall hereafter be in responsible charge of
well drilling until he shall have received a license as a well
driller from the Department.

20. The Department is hereby authorized and empowered to
grant and issue licenses to persons desiring or intending to en-
gage in the trade, business or calling of well driller within the
boundaries of the State in the manner and upon the terms and
conditions hereinafter provided.

21. The Department is hereby authorized, empowered and
directed to prescribe, amend and enforce rules and regulations
