versity of Maryland being situated within the boundaries of
the Town of College Park as defined by this Charter; and in
consideration of certain functions and activities of the Uni-
versity of Maryland and of its personnel being performed with-
in the said boundaries of the Town of College Park; and in
consideration of the use by the administrative personnel and
students of the University of Maryland of the roads, streets,
highways, and facilities of the Town of College Park; and in
consideration of their enjoyment of the privileges and benefits
of the government of said Town; and since the University of
Maryland is exempt from all taxes levied by the Town; there-
fore, the Board of Regents of the University of Maryland is
hereby authorized to pay unto the Treasurer of the Town of
College Park such sum or sums of money annually as shall be
fixed by the said Board of Regents for the use and benefit of
the government of the said Town with which to defray, in part,
its governmental expenses and otherwise to expend as the
Mayor and Common Council, in its judgment, shall determine
for the benefit of said Town.

SEC. 25. And be it further enacted, That if any part of this
Act, or any section, sub-section, or a part of any section or
sub-section thereof, shall be held unconstitutional or invalid,
the same shall not affect the remaining part of this Act.

SEC. 26. And be it further enacted, That for the purpose
of determining whether the other provisions of this Act shall
become effective and whether the citizens of the said proposed
Town of College Park desire to incorporate, there shall be
held a referendum election on or before the first Monday in
June, 1945, under the supervision of the Committee hereinafter
named, the manner and procedure of which shall be as fol-
lows:

The Committee to conduct such referendum election shall
consist of Mr. Herbert W. Wells, Calvert Hills, College Park,
Maryland; Mr. Emanuel F. Zelesak, College Park, Maryland;
Mr. Leland G. Worthington, Berwyn, Maryland; and Mrs.
Sylvia N. Stephens, Lakeland, College Park, Maryland, who
shall act as a Board of Election Supervisors, and they shall
have the same duties, powers, authority as. is provided for
Supervisors of Election in this Charter, and if any of said Com-
mittee are unable or decline to serve, the remaining members
of said Committee are empowered to select some resident of
said proposed Town to fill his place.

The qualifications of voters in the referendum election shall
be the same as those set forth for General Town elections pro-
vided for in the Charter enacted by this Act.

The said Committee shall provide registration books, booths,
ballot boxes, tally sheets, printed ballots and places of regis-
