CHAPTER 970.
(Senate Bill 435)

AN ACT to repeal and re-enact, with amendments, Section
44 (b) of Article 99 of the Annotated Code of Maryland
(1943 Supplement), title "Birds, Game and Inland Water
Fish, " sub-title "Water Fowl and Migratory Birds, "
relating to duck blinds in Charles County.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 44 (b) of Article 99 of the Annotated Code
of Maryland (1943 Supplement), title "Birds, Game and
Inland Water Fish, " sub-title "Water Fowl and Migratory
Birds, " be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

44.

(b) In the tributaries of the Potomac River in
Charles County and on the waters of Baltimore County
said blinds shall not be less than 250 yards apart measured
in a straight line nor exceed a greater distance than 150
yards from the natural shore from which same may be
erected. Provided that on the tributaries of the Potomac
River in Charles County no blind shall be placed nearer
than 125 yards of any property owned or leased by him
and the adjoining property bordering on said waters, un-
less with the consent of the adjoining landowners, same
being for the purpose of allowing each landowner or lessee
bordering on the tributaries of the Potomac River in
Charles County permission to avail himself of the privilege
of setting, erecting or maintaining a booby, brush or stake
blind in front of his property provided he is the owner,
lessee or licensee of the amount of shore frontage as re-
quired by law. However, the 250 yards as provided in
Section 49 shall not apply to the above sections.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1945.
