1608 LAWS OF MARYLAND. [CH. 941

Sections 1130A, 1130B and 1130C, and to follow immediately
after Section 1130 of said Article, providing generally for the
regulation in Montgomery County of taxicabs and their
owners and operators by the County Commissioners of Mont-
gomery County, and providing for the regulation and fixing
of rates in Montgomery County to be charged for the trans-
portation of passengers by said taxicabs and their owners
and operators, by the County Commissioners of Montgom-
ery County, and providing penalties for violation of such
regulations.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,, That three new sections be and they are hereby added to
Article 16 of the Code of Public Local Laws of Maryland (1939
Edition), title "Montgomery County", to be under a new sub-
title "Taxicabs", said new sections to be known as Sections
1130A, 1130B and 1130 C, to follow immediately after Section
1130 of said Article, and to read as follows:

TAXICABS

1130A. The term "Taxicab" as used in this sub-title shall
embrace any motor vehicle for hire, designed to carry seven
persons or less, including driver, operated upon any public
street or highway in Montgomery County, or, on call or de-
mand, accepting or soliciting passengers indiscriminately for
transportation for hire between such points along public streets
or highways in this State, as may be directed by the passenger
or passengers so being transported; provided that nothing in
this sub-title shall be construed to include as a taxicab, a motor
vehicle operated, with the approval of the Public Service Com-
mission, on fixed routes and schedules.

1130B. In order to protect the public health, safety and
welfare of the citizens of Montgomery County and other per-
sons who may use taxicab facilities therein, the County Com-
missioners of Montgomery County are hereby authorized and
empowered to enact, amend and repeal ordinances, providing
regulations for the ownership and operation of taxicabs in
Montgomery County, and to provide for and fix the require-
ments for the registration, licensing and inspection of taxi-
cabs, their owners and operators; and to provide for and fix
the rates which may be charged by said taxicab owners and
operators for the transportation of passengers. The regula-
tions herein provided for taxicabs in Montgomery County
shall be in addition to any regulations by the Commissioner of
Motor Vehicles of Maryland or the Public Service Commission
of Maryland.

1130C. Any person, firm or corporation violating any ordin-
ance promulgated under the authority of Section 1130B shall
