shall take or catch oysters on such leased land by any device
other than tongs or patent tongs.

(u) License for Lessee. Any lessee desiring to take or
catch oysters from any leased area by dredge or scrape shall
apply to the Department of Tidewater Fisheries for an annual
license, and for such license shall pay a fee of Fifteen Dollars
($15. 00), provided, however, that no license shall be required
in Worcester County.

(v) Season for Taking or Catching Cultivated Oysters.
The season for taking or catching oysters for sale from leased
areas of this State shall be between sunrise and sunset of any
day, except Sunday, between the first day of October and the
first day of April, inclusive, next succeeding, except in Wor-
cester County, where oysters are permitted to be taken and
sold at any time; provided, however, that any lessee desiring
to take or catch oysters by dredge or hand scrape during
October, or during the last fifteen days of March, shall give
written notice of his intention so to do to the nearest officer
of the Department of Tidewater Fisheries, and such notice
shall name the day and hour when he intends to take or catch
oysters and shall be mailed to said officer at least three days
in advance of the date named in the notice.

(w) Seed Oysters for Lessees. It shall be lawful during the
closed season for taking oysters to take oysters from the
natural bars of the Chesapeake Bay for a period not to exceed
one month in any year, from such bars as the Department of
Tidewater Fisheries shall mark out and at such times as the
said Department shall designate; provided, however, that such
oysters shall be taken only in accordance with regulations pre
scribed by the Department of Tidewater Fisheries and shall
be sold only to bona fide lessees of private oyster grounds and
shall be delivered only upon lands which are under lease
according to the provisions of this section.

(x) Season for Transplanting and Cultivating Oysters. It
shall be lawful for any bona fide lessee to take oysters at any
time from his leased land for private use or for the purpose
of planting or cultivating, or for sale for planting by other
lessees; or for any person to import into this State at any
time any oysters of the species Ostrea-virginica for the purpose
of planting on his own leased land or land leased by the State
to any other person.

(y) Disposition of Oysters Culture Fees. All fees, funds
and revenues derived from the administration of the pro-
visions of this section shall be paid to the Comptroller of the
Treasury to be credited to the Oyster Fund.
