Third: No right shall exist to redeem or purchase any
land of the State so leased; and
Fourth: Any other modification caused by the provisions
of this sub-title.
(q) Transfer of Lease. No assignment or transfer of any
interest acquired by this sub-title shall be valid for any pur-
pose if made to a non-resident of this State. If any such
assignment is attempted to be made, all interest of the grantor,
or assignor, shall revert to the State as if no lease had ever
been made. If any assignment of any interest created by this
sub-title is attempted to be made to any corporation or joint
stock company, all the interest of the grantor or assignor
shall revert to the State as if no lease had ever been made.
If any assignment of any interest1 created by this sub-title is
attempted to be made to any person in such a way that the
assignee shall become the holder of more than thirty acres,
fifty acres, one hundred acres or five hundred acres, as the
case may be, according to the location of land leased under
this sub-title, all interest of the grantor or assignor, in case
of such an assignment, shall revert to the State as if no lease
had been made.
(r) Protecting Oysters on Leased Land. It shall be un-
lawful for any person, other than the lessee, to willfully
and without authority take or remove oysters from any land
leased under the provisions of this section, or to willfully
destroy or transfer oysters on such land in any manner, or to
remove, alter or transfer any stake, buoy or monument mark-
ing the same.
(s) Appropriation of Land Without a Lease. It shall be
unlawful for any person other than a lessee, under the pro-
visions of this section, or for any lessee, while he shall be in
default in payment of any rent or fees, to appropriate to him-
self or to use for any purpose, any of the submerged lands of
this State; provided, however, that any person may use at his
own risk any submerged land subject to lease and not already
leased for the temporary bedding of oysters for a period not
to exceed three months.
(t) Methods of Taking or Catching Cultivated Oysters. A
lessee is privileged "to cultivate or remove oysters so planted
on his leased area in any manner that he deems proper, pro-
vided he has complied with the law providing for the licensing
of boats or tongers in removing them for market or trans-
planting; and provided, however, that no lessee or holder of
any submerged area in Dorchester, Charles, Queen Anne's or
Kent Counties, or in the Manokin River in Somerset County,
