the County Commissioners of said County and to fix the salary
of the Assistant Treasurer at not more than Twelve Hundred
Dollars ($1, 200. 00) per year, to be paid monthly by the said
County Commissioners; and before he enters upon the dis-
charge of the duties of his said office as treasurer, he and his
successors in office shall take and subscribe before the Clerk of
the Circuit Court the oath prescribed by Section 6 of Article 1
of the Constitution of Maryland; and shall execute to the State
of Maryland a corporate surety bond in such penal sum as the
State Comptroller may prescribe, with the condition that if the
above bound County Treasurer shall well and faithfully exe-
cute his office and shall account for to the Comptroller and pay
to the Treasurer of the State the several sums of money which
he shall receive for the State, or be answerable for by law, at
such times as the law shall direct, then the said obligation
to be void, otherwise to remain in full force and effect, and
shall execute to St. Mary's County, a bond in the penalty of
twenty-five thousand dollars, conditioned for the proper col-
lection and disbursement of all moneys coming into his hands
for the county, and the faithful performance of other duties
devolving upon him; such bonds to be approved as bonds of
the sheriffs of the respective counties of this State are approved
and to be recorded in the office of the Clerk of the Circuit
Court for St. Mary's County, and the bond of the State shall
be forwarded to the State Comptroller as soon as it shall have
been recorded, as above required..

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.

CHAPTER 178.
(House Bill 104)

AN ACT to repeal Sections 239 and 240 of Article 23 of the
Annotated Code of Maryland (1939 Edition), title "Cor-
porations", sub-title "Railroad Companies", said sections
relating to the purchase of an uncompleted railroad.

WHEREAS, the provisions of these sections are no longer ap-
plicable, since the creation of the Public Service Commission;
therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 239 and 240 of Article 23 of the Annotated
