Code of Maryland (1939 Edition), title "Corporations", sub-
title "Railroad Companies", be and they are hereby repealed.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.

CHAPTER 179.
(House Bill 157)

AN ACT to repeal and re-enact, with amendments, Section 758
of Article 22 of the Code of Public Local Laws of Maryland
(1930 Edition), title "Washington County", sub-title
"Smithsburg", and to add a new section to said Article, to
be known as Section 758A and to follow immediately after
Section 758 of said Article, relating to the authority of the
Burgess and Commissioners of said town to acquire prop-
erty, including property for a library, and authorizing the
operation and maintenance of library service, and correcting
errors.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 758 of Article 22 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Washington
County", sub-title "Smithsburg", be and it is hereby repealed
and re-enacted, with amendments, and that a new section be
and it is hereby added to said Article 22, said new section to
be known as Section 758A, to follow immediately after Section
758 of said Article, and all to read as follows:

758. The inhabitants of the town formerly known as Smiths-
burg, in Washington County, are created a corporation, by the
name of The Burgess and Commissioners of Smithsburg, and
by that name shall have perpetual succession, may be sued
and may sue, may have and use a common seal, and possess
such other incidents and powers as attach by law to a
municipal corporation, and acquire by purchase, lease, gift
or otherwise, and hold real, personal and mixed property
for the benefit of said corporation; provided, however, that
the burgess and commissioners shall not purchase or acquire
any real estate, unless the said burgess and commissioners
shall first provide by ordinance for said purchase, and the
mode and manner of payment therefor; and all ordinances
for the purchase of real estate shall provide for the sub-
mission of the question of said purchase to the qualified
