PROHIBITION WITHOUT LICENSE OR PERMIT AND EXCEPTIONS.

2. (a) It shall be unlawful for any person to manufacture,
blend, rectify, bottle, transport, import or sell, or suffer to
be manufactured, blended, rectified, bottled, transported, im-
ported or sold, or keep or suffer to be kept on his premises,
in his possession or under his charge or control, for the pur-
pose of sale and delivery within this State, any alcoholic bev-
erage except as provided for in this Article. It shall also be
unlawful for any person to possess any alcoholic beverages
upon which the taxes provided by the tax provisions of this
Article have not been paid, unless otherwise provided in this
Article. The tax provided for in this Article shall not be
payable with respect to alcohol and alcoholic beverages ob-
tained under a Non-Beverage permit or obtained in accord-
ance with the provisions of Sub-section (e) of this section.

(b) (Homemade Wine. ) No license or permit shall be re-
quired for the manufacture of wine or cider exclusively for
home consumption and not for sale.

(c) (Sales Permitted Without License or Permit. ) No li-
cense or permit shall be required in the case of a common
carrier, warehouseman or other lien-holder exercising his
right to sell alcoholic beverages under a lien; or any author-
ized county or Baltimore City official exercising his right to
sell certain confiscated alcoholic beverages as hereinafter
provided; or any sheriff, constable, receiver, auctioneer, trus-
tee, attorney, executor or administrator selling alcoholic
beverages under an order of Court; but no such sale shall
be made except to a license holder, and if the purchaser is a
retail dealer, the person making the sale shall pay the taxes
imposed by this Article before delivery is made to the pur-
chaser.

(d) (Warehouse Receipts. ) Warehouse receipts covering
alcoholic beverages on storage in public (which includes gov-
ernment controlled) warehouses in this State may be pur-
chased or sold without a license, but no withdrawals or deliv-
eries of such beverages shall be made in this State except
to licensed manufacturers and wholesalers. The Comptroller
may prescribe regulations covering Warehouse Receipt trans-
actions.

(e) (Planes and Ships. ) No license shall be required of
transport planes furnished with a cocktail lounge, or ships
carrying passengers or cargo to a foreign port, to purchase
alcoholic beverages from wholesalers or manufacturers pro-
vided satisfactory proof in writing is furnished that such
beverages are for sale or use beyond the continental limits
and possessions of the United States.

(f) All alcoholic beverages kept, possessed, used, sold,
manufactured, stored, or transported contrary to the provi-
