SEC. 2. Be it enacted, That no commission issued
by the Governor, to any person to act as commis-
sioner of said county, except such as have issued
upon the returns of the judges of election of said
county, shall have any force or effect, or confer any
power or authority whatever, until the final deter-
mination of said case, under the provisions of the

above section; Provided, this shall not interfere
with the right to fill any vacancy, caused by the
death, resignation or removal from the county, of
any of the present board of commissioners, re-
turned as elected by the judges of election of said
county.

AN ACT to incorporate the trustees of the Or-
phans' Home, in Baltimore city.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Reverend James Dolan,
Basil R. Spalding, John Ahern, Michael Courteney
Jenkins, Thomas Parkin Scott, William Kennedy,
Richard McDonnell, Alfred Jenkins and William
F. Lucas, of Baltimore city, be and they are here-
by created a body corporate, by the name and style
of the trustees of the Orphans' Home, in Baltimore
city, and by that name they and their successors
shall have perpetual succession, and may take, re-
ceive and hold any real and personal estate, not
exceeding in annual value, exclusive of the house
and grounds occupied by the Orphans', the sum of
ten thousand dollars, by gift, deed or devise; and
the said estate and property may lease, sell, mort-
gage and convey by deed or otherwise, for the use
of the said corporation; and may make and have a
common seal, and alter and renew the same at
pleasure; and may sue and be sued, and may pro-
vide by by-laws for the perpetuation of the governing
body, and management of the affairs of the said
corporation.
