CHAPTER 361.

CHAP. 361.

AN ACT to authorise they Mayor and City Coun-
cil of Baltimore, to build a bridge over Jones'
Falls, at North Avenue.

WHEREAS, It has been represented to the Gener-
al Assembly, that under the provisions of the act
of eighteen hundred and fifty-six, chapter one hun-
dred and sixty-four, entitled an act, relating to the
grading and paving of North Avenue, in the city
of Baltimore, said avenue between Pennsylvania
Avenue and Charles street, on each side of Jones'
Falls has been graded and in part paved but owing
to the restrictions contained in the fourth section
of the act of eighteen hundred and twenty-three,
chapter one hundred and eighty-five, the mayor
and city council of Baltimore, have not been able
to levy and apply a sum sufficient for the erection
of a bridge across Jones' Falls at that point; and
whereas, it has been represented that the public
convenience requires the erection of such a bridge,
and that without it the expensive work that has
been done upon said avenue, with a view to the
construction of the two parts thereof, is compara-
tively useless to the property holders on the line of
said avenue and to the public; therefore,

Preamble.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the mayor and city council of
Baltimore, be and they are hereby authorised when-
ever, in their opinion, the public convenience may
require the same, to construct a bridge across Jones'
Falls, at the North Avenue, to connect the opposite
sides of said avenue, and render the same a tho-
roughfare, the said bridge to be of such materials,
of such height above Jones' Falls, and upon such
plan of construction, as the mayor and city council
aforesaid, may determine.

SEC. 2. And be it enacted, That in order to meet
the cost of constructing such bridge, the mayor and
city council aforesaid, shall have power to levy and
collect a tax on the assessment of all lands and
houses in said city, to such amount as may be ne-
cessary for the construction of said bridge, whenev-
er the plan and cost of construction thereof shall
been determined and ascertained, and they may en-
force the payment of said tax when levied in the
