1860.

in him, which bond shall be lodged with the clerk
of the circuit court for Kent county, be recorded
among the public records of said county, a copy of
which shall be evidence in any court of law or
equity, and suit may be instituted thereon and
judgment recorded in the names of said commis-
sioners, or their survivors, or of such as may assume
the duties imposed by this act, or apportioned under
its provisions, which said commissioners or a ma-
jority of them shall have power to fill any vacancy
occurring in the office of treasurer, and any other
person appointed treasurer shall give bond in man-
ner aforesaid.

CHAP. 23.

SEC. 5. That in case of death, resignation, or re-
fusal to act, or removal of any of the commissioners
appointed by this act, the other commissioners
shall have power to fill such vacancy or vacancies.

SEC. 6. That each of the commissioners and
treasurer shall receive such compensation for their
respective services whilst engaged in contracting
for and superintending said buildings and offices,
and their duties under this act, as the county com-
missioners shall consider due, and shall levy the
same upon the assessable property of said county.

Compensa-
tion.

SEC. 7. That the county commissioners of Kent
county are hereby authorized and required, upon
the requisition of the board of commissioners, under
this act, or a majority of them, signed by them, to
issue from time to time the bonds of said county,
to an amount not exceeding twelve thousand dol-
lars, in sums of not less than one hundred dollars,
bearing interest at the rate of six per cent, per
annum, and redeemable and payable at a period
not exceeding five years from the date of their issue,
which said bonds shall be delivered to the board of
commissioners under this act, to be by them nego-
tiated upon such terms and conditions as to them
may seem reasonable, and the proceeds and avails
thereof to be used in the payment for building and
furnishing said court house and offices, the interest
on the same to be paid semi-annually, and the said
bonds to be exempt from taxation.

SEC. 8. That in the erection of said offices for the
clerk of the circuit court and register of wills, the
said commissioners, or a majority of them, shall
cause the same or a sufficient portion thereof to be
made fire proof to secure the record books and pa-
