1860.

the said commissioners shall have power either to
sell the said lots and warehouses now owned by the
State, or any part thereof, and to apply the pro-
ceeds or any part thereof to the erection of a new
warehouse or warehouses, or to dispose of them in
exchange for the lot or lots hereby authorised to
be purchased, and for the erection of the ware-
house or warehouses hereby authorised to be built,
as in the opinion of said commissioners may be
most advantageous and economical; Provided, that
the said commissioners before they proceed to pur-
chase sites for said warehouses and before they pro-
ceed to enter into contracts for erecting said ware-
houses, they shall open proposals for the purchase of
said sites and the erection of said warehouses setting
forth the number of contiguous lots together with
the warehouses to be built thereon, and all the
necessary specifications relating thereto, as also the
day when said proposals shall be opened, and the
contract or contracts awarded and the said contract
or contracts shall be awarded to the lowest re-
sponsible bidder for the erection of said warehouses,
and the lowest offer per foot for the fee simple title
to said lots upon which said warehouses may be
erected.

CHAP. 225.

SEC. 5. And be it enacted, That the said ware-
house or warehouses shall be fire-proof, built upon
the most approved plan, and in the most substan-
tial manner, and in case the said commissioners
shall determine to build more than one, they shall
be erected upon adjoining lots, so that the inspec-
tion of all the tobacco inspected in the city of Balti-
more may be conducted under the supervision of all
inspectors, instead of separately and in different
warehouses, as by the existing law and practice.

SEC. 6. And be it enacted, That it shall be the
duty of the said commissioners to require all per-
sons contracting with them for the erection of the
said warehouse or warehouses, or for any part
thereof, to give bond to the State, in penalties fixed
by them, and with sureties to be by them approved,
conditioned for the faithful performance of said
contract or contracts according to the terms thereof,
which bond or bonds shall be recorded in the office
of the clerk of the Superior court for Baltimore
city, and a copy thereof, under the seal of said
court, shall be as good and sufficient evidence
thereof in any court, as if the original thereof had
been produced and proved.
