CHAPTER 144.

CHAP. 144.

AN ACT to incorporate a company to construct a
turnpike road from the city of Cumberland, by
the nearest and most practicable line, to Bedford,
Pennsylvania.

24, 1860.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Thos. J. McKaig, Peter Smouse,
William Frantz, Michael Brotemarkle, John Beall,
David W. McCleary, J. W. Jones, Daniel Wine-
owe, Alpheus Beall, Asahel Willison, Samuel Lu-
man, Henry Wineowe, Josiah H. Gordon, and
William Hall, be and they are hereby appointed
commissioners, who shall cause books to be opened,
at such place or places as they may deem advisable,
for the purpose of receiving subscriptions to the
capital stock of the company hereby created by
the provisions of this act, notice having been
given for at least three previous weeks, by the
said commissioners of the opening of the said
books, at such place or places as the said commis-
sioners, or a majority of them, may deem expedient
to complete such subscription.

SEC. 2. And be it enacted, That the capital stock
of said company shall be forty thousand dollars, in
shares of twenty dollars each, and all individuals,
bodies politic and corporate, are hereby authorised
and empowered to subscribe such amount of stock

as they may think proper; Provided, nevertheless,
that if the subscription shall not exceed the amount
required and authorized by this act, the commis-
sioners shall regulate the same in such manner as
to effect a just apportionment of the stock among
the subscribers; Provided, also, that at the time
of making the subscription to the capital stock
there shall be paid to the commissioners, upon such
shares, one dollar on each share, the residue thereof
shall be paid at such time and in such manner as
may be prescribed by the president and directors of
the company, by this act to be incorporated.

Provisos.

SEC. 3, And be it enacted, That whenever one-
fourth of the shares of said stock shall be sub-
scribed, then the said subscribers shall be declared
to be incorporated, and be made a body politic
and corporate by the name of Cumberland and
Bedford Turnpike Road Company, for the purpose
