thereafter, and shall be kept in repair as other pub-
lic roads are directed to be kept in said counties.

Expenses in-
curred to be
paid by the
county.

SEC. 2. And be it enacted, That the expenses
of locating and opening that part of said road
through Howard county, shall be paid by Howard
county, and the expenses of locating and opening
that part of said road through Montgomery county,
shall be paid by Montgomery county, and the com-
missioners of said counties are hereby authorised
and required on receiving from the commissioners
hereby appointed, an account on oath of the said
expenses, including an allowance of two dollars per
day to the commissioners for their services, to levy
the same on the assessable property of said coun-
ties wherein such expense may accrue respectively
to be collected as other county charges are now col-
lected.

Damages to
land owners.

SEC. 3. And be it enacted, That the said commis-
sioners hereby appointed shall value the damages
that may be sustained by the persons through
whose land the said road may pass, taking in
view the advantages and disadvantages of said road
to each, and the damages so ascertained shall be
levied and assessed in each county as other charges
are, and shall be paid by the county wherein such
damages may be sustained.

Commission-

to make oath.

SEC. 4. And be it enacted, That the said com-
missioners before they proceed to act shall take an
oath before some justice of the peace that they will
without favor or partiality or prejudice assess the
damages sustained by persons whose land the said
road shall pass through, and that they will per-
form all duties of commissioners faithfully and to
the best of their judgment.

In force.

SEC. 5. And be it enacted, That this act shall take
effect from the date of its passage.
