WHEREAS, by an act of the General Assembly of
the State of Delaware, passed at Dover, February
seventeenth, eighteen hundred and fifty-seven,
chapter three hundred and sixty-one, entitled, an
act to incorporate the Mispillion and Choptank
Railroad company, the said company was incor-
porated and authorised to construct a railroad with
one or more tracks, to begin at Farmington on or near
the Delaware Railroad or at some point within one
mile thereof to be selected by the company, and
from the point so selected and fixed on the Delaware
Railroad, to run the most eligible line or route to
the line dividing the States of Delaware and Mary-
land, to intersect said State or dividing line at a
point as near as practicable in a direct line from
the aforesaid place of beginning to such point in
the Choptank river in the State of Maryland, be-
tween Denton and Potter's landing on said river, as
may be selected and fixed by said company; And
whereas, the said company have in conformity with
the provisions of the act of incorporation aforesaid
surveyed and located the line of the said railroad,
to a point on the aforesaid line dividing the States
of Delaware and Maryland; And whereas, under
and by virtue of the provisions of an act of the
General Assembly of this State, entitled, an act to
provide for the formation of corporations for the
building of a railroad in Caroline county, passed
at Annapolis, March tenth, eighteen hundred and
fifty-eight, a company was formed under the name,
style and title of the Mispillion and Choptank
Railroad company, for the purpose of surveying,
locating and constructing a railroad, to begin at or
near Potter's landing, on the Choptank river, and
to run by the most eligible route or line to the point
on the aforesaid State line, where the same shall be
tapped by the railroad authorised by the aforesaid
act of the Legislature of Delaware incorporating
said company in that State, so as to make the
railroad proposed to be constructed by the com-
pany authorised by the aforesaid act, of the Gen-
eral Assembly of this State, a continuation of the
Mispillion and Choptank Railroad, authorised by
