CHAP. 126.

the aforesaid act of incorporation by the Legisla-
ture of Delaware; And whereas, the said com-
pany authorised by the said act of the General As-
sembly of this State, possess no authority under
said act to condemn lands for the purpose of build-
ing said railroad, and are subject to inconveniences
and disabilities inconsistent with the objects con-
templated by the aforesaid act of the General As-
sembly of this State, therefore for the purpose of
carrying out the objects proposed by the said acts
of the General Assembly of both States:

Incorporated.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the subscribers to the stock of
Mispillion and Choptank Railroad company, in-
corporated by the Legislature of Delaware afore-
said, their successors and assigns shall be, and
they are hereby declared by the name, style and
title of Mispillion and Choptank Railroad com-
pany, and by that name, shall have perpetual suc-
cession, and be capable in law of purchasing, re-
ceiving, holding, using, selling, leasing, mortgag-
ing and conveying goods and chatties, lands, tene-
ments, hereditaments and all estate, real, personal
and mixed, of what kind or quality soever, may sue
and be sued, plead and be impleaded in all courts
of this State, may make, have and use a common
seal, and the same may alter or renew at pleasure,
and also, may ordain, establish and enforce such
by-laws and regulations, as they shall deem neces-
sary for the government of said corporation, not
repugnant to the Constitution and laws of this
State, and of the United States, and generally may
do all and singular the matters and things, and ex-
ercise and enjoy all rights, powers and privileges
which to them may properly appertain for the well
being and ordering of the said corporation; Pro-

vided, that nothing herein contained, shall be con-
strued as in any way giving to the said corpora-
tion any banking privileges whatsoever or any
other powers or privileges than such as are neces-
sary or incident to the making and proper manage-
ment of the railroad mentioned in this act.

SEC. 2. And be it enacted, That the said Mis-
pillion and Choptank Railroad company, be and
they are hereby authorised and empowered to ex-
tend and construct their said railroad within the
limits of the State of Maryland, from the point on
