1860.

of the taxes levied in the year eighteen hundred
and fifty-nine, and before he shall enter upon said
duty he shall give additional bond and security to
the State of Maryland for the faithful performance
of his duties according to the existing tax laws,
and said bond shall be filed in the office of the Cir-
cuit court for Howard county, and be by the clerk
of said court recorded; and in case of failure of the
sheriff to execute said bond, he shall incur a
penalty of one thousand dollars recoverable for the
use of the State by indictment in the Circuit court
for said county, and his returns and payments to
the State and county hereinafter provided for shall
be verified by oath made before some justice of the
peace.

CHAP. 97.

And be it further enacted, That the twenty-third,
twenty-fourth and twenty-fifth sections of said arti-
cle, relating to the collection of State and county
taxes in Howard county, be and the same are
hereby repealed, and the following enacted as sub-
stitutes therefor:

23. From and after the expiration of the term
for which the present treasurer of Howard county
has been elected, or at his death or resignation, in
case either should take place previously to the ex-
piration of said term, the office of treasurer of said
county shall be and is hereby declared to be abol-
ished, and thenceforth all the duties by this article
imposed upon the said treasurer shall be performed
by the commissioners of the county, and all ac-
counts, returns; statements and payments of col-
lectors, by this law required to be made to said
treasurer, shall be made to said commissioners;
and said treasurer shall at the expiration of his
term of service transfer and deliver to the commis-
sioners of the county all books, accounts, money
and papers of every kind and nature whatsoever,
in any way connected with the administration of
his office.

24. The said commissioners may allow the said
treasurer, as a salary for his services as treasurer
and clerk of commissioners, a sum not exceeding
eight hundred dollars per annum; and after the
expiration of his term, the said commissioners may
appoint a clerk and allow him a salary not exceed-
ing five hundred dollars per annum, and they may
prescribe the duties of the said clerk, and they may
